Terms and Conditions

Article 1 – Definitions

In these terms and conditions, the following definitions apply:

Cooling-off period: the period within which the consumer may exercise their right of withdrawal.

Consumer: the natural person who is not acting in the exercise of a profession or business and who enters into a distance contract with the entrepreneur.

Day: calendar day.

Long-term transaction: a distance contract relating to a series of products and/or services where the delivery and/or purchase obligation is spread over time.

Durable data carrier: any means that enables the consumer or entrepreneur to store information addressed personally to them in a way that allows future consultation and unchanged reproduction of the stored information.

Right of withdrawal: the possibility for the consumer to withdraw from the distance contract within the cooling-off period.

Entrepreneur: the natural or legal person who offers products and/or services to consumers at a distance.

Distance contract: a contract concluded within the framework of an organized system for distance selling of products and/or services, whereby exclusive use is made of one or more means of distance communication up to and including the moment the contract is concluded.

Means of distance communication: any means that can be used to conclude a contract without the consumer and entrepreneur being present in the same space at the same time.

General Terms and Conditions: the present General Terms and Conditions of the entrepreneur.

Article 2 – Applicability

These general terms and conditions apply to every offer made by the entrepreneur and to every distance contract concluded between the entrepreneur and the consumer.

Before the distance contract is concluded, the text of these general terms and conditions will be made available to the consumer. If this is not reasonably possible, it will be indicated before the distance contract is concluded that the general terms and conditions can be inspected at the entrepreneur’s premises and that they will be sent free of charge upon request.

If the distance contract is concluded electronically, the text of these terms may be made available electronically before the contract is concluded in such a way that the consumer can easily store them on a durable data carrier.

If specific product or service conditions apply in addition to these terms, the consumer may always rely on the provision most favorable to them in the event of conflicting conditions.

If one or more provisions in these terms become invalid or void, the remainder of the agreement will remain in force.

Situations not covered by these terms will be assessed in accordance with the spirit of these terms and conditions.

Article 3 – The Offer

If an offer has a limited validity period or is subject to conditions, this will be explicitly stated.

The offer is non-binding. The entrepreneur is entitled to modify and adjust the offer.

The offer contains a complete and accurate description of the products and/or services offered. Images used represent the products as truthfully as possible. However, displayed colors may differ slightly from the actual product.

All images, specifications, and data in the offer are indicative and cannot give rise to compensation or dissolution of the agreement.

Each offer contains information that makes it clear to the consumer what rights and obligations are attached to accepting the offer, including:

  • the price excluding customs clearance costs and import VAT

  • any shipping costs

  • the method of payment, delivery, and execution of the agreement

  • whether the right of withdrawal applies

  • the period for acceptance of the offer

  • whether the agreement will be archived and how it can be accessed

  • the languages in which the agreement can be concluded

  • the minimum duration of the agreement in the case of long-term transactions

Optional information may include available sizes, colors, and materials.

Article 4 – The Agreement

The agreement is concluded at the moment the consumer accepts the offer and fulfills the conditions stated.

If the consumer has accepted the offer electronically, the entrepreneur will confirm receipt electronically without delay.

The entrepreneur will take appropriate technical and organizational measures to secure electronic data transfers and ensure a safe web environment.

The entrepreneur may verify whether the consumer can meet their payment obligations and may refuse an order or attach special conditions if justified.

The entrepreneur will provide the consumer with the following information together with the product or service:

  • the business address where complaints can be submitted

  • the conditions and method for exercising the right of withdrawal

  • information about guarantees and after-sales service

  • requirements for terminating agreements with a duration longer than one year

All agreements are concluded subject to product availability.

Article 5 – Right of Withdrawal

When purchasing products, the consumer has the option to withdraw from the agreement without giving any reason within 30 days.

The cooling-off period starts the day after the consumer receives the product.

During this period, the consumer must handle the product and packaging with care and only unpack it to the extent necessary to assess the product.

If the consumer exercises the right of withdrawal, the product must be returned with all accessories and, if reasonably possible, in its original condition and packaging.

The consumer must notify the entrepreneur of the withdrawal within 30 days after receiving the product, via written message or email.

After notification, the product must be returned within 30 days.

The consumer must provide proof of return shipment.

If the consumer fails to notify the entrepreneur or return the product within the specified time, the purchase becomes final.

Article 6 – Costs in Case of Withdrawal

If the consumer exercises the right of withdrawal, the costs of returning the products are for the consumer.

Any payments made by the consumer will be refunded as soon as possible, but no later than 30 days after withdrawal, provided the product has been received or proof of return shipment has been provided.

Article 7 – Exclusion of the Right of Withdrawal

The entrepreneur may exclude the right of withdrawal for certain products if this was clearly stated before the agreement was concluded.

Exclusion applies to products:

  • made according to consumer specifications

  • clearly personal in nature

  • that cannot be returned due to their nature

  • that spoil or age quickly

  • whose price depends on financial market fluctuations

  • newspapers and magazines

  • audio/video recordings and software with broken seals

  • hygienic products with broken seals

Services excluded from withdrawal include:

  • accommodation, transport, restaurant services, or leisure activities on a specific date

  • services started with consumer consent before the cooling-off period ends

  • betting and lotteries

Article 8 – The Price

During the validity period stated in the offer, prices will not be increased except for changes in VAT rates.

Products whose prices depend on financial market fluctuations may be offered with variable prices.

Price increases within 3 months after concluding the agreement are only allowed if they result from legal regulations.

Delivery takes place outside the EU. Therefore import VAT and clearance costs may be charged by the postal or courier service.

All prices are subject to typographical errors.

Article 10 – Conformity and Warranty

The entrepreneur guarantees that the products comply with the agreement, the specifications stated in the offer, and reasonable standards of reliability and usability.

Any defects must be reported within 30 days after delivery.

Returned products must be sent back in the original packaging and in new condition.

The warranty does not apply if:

  • the consumer has repaired or modified the product

  • the product has been exposed to abnormal conditions

  • the product was used contrary to instructions

Article 11 – Delivery and Execution

The entrepreneur will exercise the greatest possible care when receiving and executing product orders.

The delivery address is the address provided by the consumer.

Orders will be processed as quickly as possible and no later than 30 days, unless a longer delivery period has been agreed.

If delivery is delayed or partially unavailable, the consumer will be informed within 30 days and may cancel the order.

Risk of damage or loss remains with the entrepreneur until the product has been delivered to the consumer.

Article 12 – Duration Transactions: Termination and Renewal

Consumers may terminate agreements concluded for an indefinite period at any time with a notice period of one month.

Fixed-term agreements may be terminated at the end of the term with a notice period of one month.

Automatic renewals are limited and must comply with consumer protection laws.

Article 13 – Payment

Unless otherwise agreed, payments must be made within 7 working days after the cooling-off period begins.

Consumers must immediately report inaccuracies in payment details.

In the event of non-payment, the entrepreneur may charge reasonable costs within legal limits.

Article 14 – Complaints Procedure

Complaints about the execution of the agreement must be submitted within 7 days after the defect was discovered.

Complaints will be answered within 30 days.

If a complaint requires longer processing time, the consumer will receive confirmation and an estimated response time.

If a complaint is justified, the entrepreneur will replace or repair the product free of charge.

Article 15 – Disputes

All agreements between the entrepreneur and the consumer are exclusively governed by American law, even if the consumer resides abroad.

Article 16 – CESOP

Due to regulations introduced in 2024 regarding the Central Electronic System of Payment Information (CESOP), payment service providers may record payment data in the European CESOP system in accordance with EU legislation.
